The Standing Rock Analysis

Redthought.org will offer a special two-part presentation on Standing Rock Sioux Tribe and Cheyenne River Sioux Tribe v. U.S. Army Corps of Engineers and Dakota Access, LLC., a legal challenge to defend Oceti Sakowin (“Seven Council Fires”) lands against the invasion of an oil pipeline. The case went through 16 hearings between September 2016 and May 2021 and is now the subject of an appeal to the US Supreme Court filed by Dakota Access on September 20, 2021. 

Part One of the presentation focuses on the litigation, which, as the federal district court judge put it, “has wound its way through myriad twists and turns.” The “twists and turns” will be examined in light of the dominating legal presumption that the US “owns” the land where the pipeline is constructed—this is called the “doctrine of Christian discovery.” 

Part Two of the presentation focuses on the history of treaty relations and US congressional acts that, step by step, confined the Oceti Sakowin within “reservations.” The texts of the various documents will be compared with territorial maps, showing how present-day boundaries were created and defined as US property.
